Service Agreement

Moovment.Coach is a health and fitness ‘Service Provider’ company that is registered in Stockholm, Sweden, and governed by the General Data Protection Regulation (GDPR). Moovment.Coach, with its employees and associates need access to Your personal data to perform their role in assessing your personal health and fitness and to make recommendations about how to improve health and fitness.

By using the software and services provided by Qinematic AB (registered in Sweden) to Moovment.Coach, You knowingly consent to sharing your personal information with Moovment.Coach and its employees and associates. You can independently revoke access to your data at any time, and you can delete your data at any time in the Moovment.Pro Portal. You can also request to share your data with other Organisations that have a Moovment software subscription. Moovment.Coach or any other Organisation are not obliged to accept Your request to share data with them. Moovment.Coach can revoke its access to your data at any time, without warning. As controller of Your data you will retain access to your data as long as you have a valid subscription with Qinematic.

According to GDPR, You are the Controller of your data, and you consent to share the data with Moovment.Coach, who then becomes a Co-controller until either party revokes access. Qinematic is the Processor of any data on behalf of Yourself and Moovment.Coach. Your data is stored in Ireland (EU) using Microsoft Azure, in full compliance with GDPR and Microsoft’s Gold Standard security.

Moovment.Coach International will access your personal information for the following purposes:

  1. to understand if there is any self-reported background discomfort or balance deficits

  2. estimate measurements for your stature, posture, balance and movement

  3. to assist in providing you with advice to improve your health and fitness

  4. to administrate your account and to provide, and improve your experience with the Service, and to otherwise provide the Service; and

  5. to send you feedback, alerts or messages.

Data is voluntarily provided by You (the ‘Client’) to Moovment.Coach (the ‘Service Provider’). The accuracy of all subjective data is Your own responsibility. The tasks that are recorded are intended for people who can stand and ambulate independently for at least 10 minutes, who have the cognitive and sensory ability to follow visual and/or auditory instructions, and do not require supervision to undertake the tasks safely. You confirm that you can safely perform the tasks, and you agree to perform the tasks at your own risk.
Feedback and advice is provided at the discretion of the specialists working on behalf of Moovment.Coach, who may be employees of Moovment.Coach or associates. The specialists, and not Moovment.Coach, each have full responsibility for their opinions and recommendations.
Moovment.Coach endeavour to provide feedback and/or advice within ten (10) workdays from the time that both the Client and Moovment.Coach have agreed to share the data. Moovment.Coach cannot accept responsibility for any of the opinions or actions of other Organisations that the Client has agreed to share data with.

Notes:
Moovment Coach International AB (based in Sweden, reg # 559027-9922) is a service provider company.
Qinematic AB is a Swedish software company that supplied Moovment software to Moovment.Coach and to Yourself, and is the primary Processor of any data exchanged within the Moovment software system. Qinematic is not responsible for any data that is outside of the Moovment software system (eg. exported data). Please check with your Provider about any such data.

By using the service You actively consent to Qinematic collecting and processes your Personal Data also for its own, limited purposes:

  1. for research purposes (for example whereby Qinematic alone, or together with e.g. a professional research institute, analyse anonymised data generated by the Service), and

  2. to develop and improve the Services.
